  1. Introduction

Welcome to LKD Racing (“LKD Racing,” “we,” “us,” or “our”), owned and operated by Linda K. Dixon, providing racehorse training, conditioning, coaching, grooming, and race day preparation services based at Finger Lakes Racetrack, Farmington, New York. These Terms and Conditions (“Terms”) govern your use of our website (the “Site”) and any services you book with us (the “Services”). By accessing our Site, contacting us, or engaging our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Site or Services.

  1. Description of Services

LKD Racing provides personalized training and care services for horses, including but not limited to Race Horse Training, Thoroughbred Conditioning, Performance Coaching, Horse Grooming and Care, and Race Day Preparation. Services are customized to each horse based on information provided by the owner and Linda K. Dixon’s professional assessment. We reserve the right to modify, decline, or discontinue any service at our discretion, including where we determine a horse’s health, temperament, or an owner’s requirements are not suitable for our program.

  1. Client Eligibility and Responsibilities

By engaging our Services, you represent that you are the legal owner of the horse or are authorized by the owner to arrange training and care on their behalf. You agree to provide accurate and complete information about your horse, including health history, behavioral concerns, and any known medical conditions. You are responsible for ensuring your horse has current vaccinations, health certificates, and any documentation required by Finger Lakes Racetrack or applicable state regulations. Failure to disclose relevant health or behavioral information may result in suspension or termination of Services.

  1. Assumption of Risk

You acknowledge that equine activities carry inherent risks, including but not limited to the unpredictable behavior of horses, the potential for injury to persons or property, and hazards associated with training, conditioning, and racing environments. By engaging LKD Racing’s Services, you voluntarily assume all such risks on behalf of yourself, your horse, and any individuals you authorize to be present during training or care activities. Consistent with New York’s equine activity liability principles, LKD Racing is not liable for injury or loss resulting from the inherent risks of equine activities, except where such injury results directly from our negligence or willful misconduct.

  1. Payment Terms

Fees for Services are as agreed upon at the time of booking, either verbally, by written quote, or through our Site. Payment terms, including deposits, installment schedules, and due dates, will be communicated directly to clients before Services begin. Late payments may result in suspension of Services until outstanding balances are resolved. We reserve the right to adjust pricing for future bookings with reasonable notice.

  1. Booking, Cancellation, and Refunds

Bookings for training, conditioning, coaching, grooming, or race day preparation should be arranged directly with LKD Racing in advance. We understand that plans can change; however, cancellations made with insufficient notice may affect scheduling and availability for other clients. Any deposits paid are generally non-refundable unless otherwise agreed in writing, though we will make reasonable efforts to reschedule where possible. Refunds, where applicable, will be handled on a case-by-case basis at our discretion.

  1. Care of Horses in Our Custody

Where a horse is left in our care for training, conditioning, or preparation, we agree to provide reasonable and attentive care consistent with industry standards. However, we are not liable for illness, injury, or death resulting from causes beyond our reasonable control, including pre-existing conditions, accidents, or the inherent risks of equine activities described above. Owners remain responsible for arranging and paying for veterinary care, and we will make reasonable efforts to contact owners promptly in the event of illness or injury.

  1. Photography and Media

From time to time, we may photograph or record horses and training sessions for use on our Site, social media, or promotional materials. By engaging our Services, you grant LKD Racing permission to use such images and recordings unless you notify us in writing that you do not wish to be included. We will make reasonable efforts to honor such requests going forward.

  1. Intellectual Property

All content on our Site, including text, images, logos, and graphics, is the property of LKD Racing or used with permission, and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or use our content for commercial purposes without our prior written consent.

  1. Limitation of Liability

To the fullest extent permitted by law, LKD Racing, Linda K. Dixon, and any associated staff shall not be liable for indirect, incidental, special, or consequential damages arising from your use of our Site or Services. Our total liability for any claim arising from our Services shall not exceed the amount you paid for the specific Service giving rise to the claim.

  1. Indemnification

You agree to indemnify and hold harmless LKD Racing and Linda K. Dixon from any claims, damages, losses, or expenses, including reasonable attorney’s fees, arising from your breach of these Terms, your horse’s actions, or your failure to disclose relevant information about your horse.

  1. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts located in Ontario County, New York, or another appropriate venue within New York State.

  1. Third-Party Facilities and Racetrack Rules

Our Services are provided on the grounds of Finger Lakes Racetrack, Belmont Park, and Saratoga Race Course, and clients agree to comply with all applicable rules, policies, and regulations set by the racetrack and any relevant governing racing authorities. LKD Racing is not responsible for any restrictions, delays, or requirements imposed by Finger Lakes Racetrack or other third-party facilities that may affect scheduling or the delivery of Services. Access to training areas, stalls, and racing facilities is subject to availability and the racetrack’s own policies, which may change without notice from us.

  1. Client Conduct

We expect all clients, and anyone accompanying a horse during training or care, to conduct themselves respectfully and safely around our staff, other clients, and other horses on the premises. LKD Racing reserves the right to refuse or discontinue Services to any client whose conduct, or whose horse’s behavior, poses a safety risk to people or other animals, or who repeatedly fails to follow reasonable instructions given for the safety of horses and staff.

  1. Force Majeure

LKD Racing shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to extreme weather, natural disasters, government restrictions, racetrack closures, illness, or other events commonly understood as force majeure. In such cases, we will make reasonable efforts to notify affected clients and reschedule Services where practical.

  1. Severability and Waiver

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will continue in full force and effect. Our failure to enforce any provision of these Terms shall not be construed as a waiver of that provision or any other provision.

  1. Entire Agreement

These Terms, together with any written agreement or quote provided for specific Services, constitute the entire agreement between you and LKD Racing regarding your use of our Site and Services, and supersede any prior oral or written understandings. Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship between you and LKD Racing.

  1. Changes to These Terms

We may update these Terms from time to time to reflect changes in our Services or legal requirements. Updated Terms will be posted on our Site with a revised effective date. Continued use of our Site or Services after changes are posted constitutes acceptance of the updated Terms.
